The talktocapital.com website and Capital's services: marketing, websites and the AI customer-service platform. By hiring or using any of these services, the client agrees to these terms and to the signed proposal.

The website presents Capital's services and lets you request a free diagnostic. Sending the form does not create a contract. Prices published at talktocapital.com/precos apply to the scope described; the formal proposal is sent in writing.

Capital sets up an AI assistant for the client's business, trained only on the information the client provides (services, area, hours and booking rules). It:

• answers people who contact the business first, on the business's official WhatsApp (Meta's WhatsApp Business Platform) and on the website chat;
• talks in English, Portuguese or Spanish;
• answers questions about the business, understands what the person needs and books appointments;
• hands the conversation to the client's team when needed or when the person asks;
• respects STOP, PARE and BAJA: anyone who sends one of these words stops receiving messages.

The client's team follows the conversations in a dashboard. The current service does not send business-initiated messages (such as reminders, follow-ups or re-engagement) and does not work over SMS or phone calls.

• Have a legal basis and, where the law requires it, the consent of its contacts to process their data and exchange messages.
• Comply with the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy, the WhatsApp Business terms and Meta's other terms and policies.
• Not use the service for products, services or industries prohibited by those policies or by law, such as drugs and medicines, weapons, tobacco, alcohol and gambling.
• Provide accurate information about the business and keep it up to date.
• Honor its contacts' stop requests (STOP, PARE, BAJA) and data-deletion requests.
• Not use the assistant to deceive contacts or to impersonate a person.

The WhatsApp Business account and phone number belong to the client. The client connects the account to the platform through “Connect with Facebook” and can disconnect it at any time in the dashboard, under Configurações (Settings) → WhatsApp → Desconectar (Disconnect). Capital uses this access only to operate the contracted service.

The assistant can make mistakes or give incomplete information. Important information, such as final price, availability and service conditions, must be confirmed by the client's team. Capital does not guarantee business results.

Capital may suspend or end the service if the client violates these terms, Meta's policies or the law, or if Meta restricts the client's account. Whenever possible, the client will be notified first.

Data is processed according to our Privacy policy (talktocapital.com/privacy). On the customer-service platform, the client is the controller of its contacts' data and Capital is the operator (processor).

• Monthly plans and the stand-alone AI service: initial commitment of 90 days. After that, cancellation with 30 days' notice, with no penalty.
• Prices as published at talktocapital.com/precos and in the signed proposal.
• Advertising budget is paid by the client directly to the platforms and is not part of Capital's fee.

Figures on the website are market references and results from previous work, as reported by clients. Results vary by city, industry, competition and budget, and are not a performance guarantee.

Google, Meta, WhatsApp and other platform accounts remain in the client's name.

These terms are governed by the laws of Brazil. The courts of Campinas, São Paulo, Brazil, are chosen as the venue.

We may update these terms. The date at the top shows the latest update. Important changes will be communicated to clients.
